These Terms of Service are an agreement between you ("you") and JourneyBase (Pty) Ltd (registration number 2026/773468/07), a private company registered in the Republic of South Africa ("JourneyBase", "we", "us"). By creating an account or registering a school on the JourneyBase platform (the "Service"), you agree to these Terms of Service. If you are registering on behalf of a driving school or other organisation, you confirm you have the authority to bind that organisation to these terms.
The Service — including its software, source code, design, database structure, and all underlying technology (the "Platform") — is and remains the exclusive property of JourneyBase (Pty) Ltd. Nothing in these Terms grants you any ownership interest in the Platform. You receive only a limited, non-exclusive, non-transferable right to access and use the Service for your own internal business purposes.
The Service is in active development. It may contain bugs or incomplete features, and features may be added, changed, or removed. The Service is provided "as is" and "as available", without warranty of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. JourneyBase does not guarantee any particular level of uptime, availability, or data retention. You are responsible for maintaining your own backups of any data you consider critical.

Trial accounts are supported on a best-effort basis. We aim to respond to and resolve issues raised during a free trial, but trial support is not treated with the same urgency as an active paying subscription, and no response time is guaranteed.
Paying customers (an active subscription on any paid plan) receive priority support, with issues affecting core functionality treated as urgent.
This section does not constitute a formal Service Level Agreement (SLA); no specific response or resolution time is contractually guaranteed unless separately agreed with you in writing.
4.1. Paid plans are billed monthly in advance, in South African Rand, at the price shown on our Pricing page at the time you subscribe. If we change that price, we will give you reasonable notice before it applies to your next billing cycle; continuing to use a paid plan after that point constitutes acceptance of the new price.
4.2. Subscriptions renew automatically each month until cancelled. You may cancel at any time by contacting us (via the in-app "Send feedback" option or at info@journeybase.co.za); cancellation takes effect at the end of the billing period you've already paid for, and no refund is given for the unused portion of that period except where required by law.
4.3. If a payment fails or isn't received, we may suspend or downgrade your access to paid features until it's resolved (see Section 12).
You agree to keep confidential, and not disclose to any third party, any non-public features, screenshots, documentation, pricing, or other materials relating to the Service that you access through your use of it, except with JourneyBase's prior written consent. You agree not to copy, reverse-engineer, decompile, or attempt to extract the source code of the Service, or to use your access to build a competing product.
You agree not to:
(a) use the Service for any unlawful purpose, or upload, store, or share content you do not
have the lawful right to upload, store, or share;
(b) attempt to gain unauthorised access to any part of the Service, another school's data,
or an account that is not your own;
(c) use the messaging, announcement, or feedback features to send spam, unsolicited
advertising, or abusive content;
(d) interfere with or disrupt the integrity or performance of the Service, including through
automated scraping, load-testing, or security testing without JourneyBase's prior written
consent; or
(e) use the Service to build, or inform the building of, a competing product.
If you provide JourneyBase with any feedback, suggestions, or bug reports about the Service, you grant JourneyBase a perpetual, royalty-free, worldwide licence to use that feedback for any purpose, including improving the Service, without any obligation to compensate or credit you.
You retain ownership of the data you input into the Service (learner records, bookings, documents, and similar) ("Your Content"). You grant JourneyBase a licence to host, store, and process Your Content solely for the purpose of providing and improving the Service to you.
If you upload personal information relating to learners, instructors, or other individuals, you confirm that you have the necessary rights and lawful basis to do so under the data protection law that applies to you and to them. In South Africa that is the Protection of Personal Information Act, 2013 ("POPIA"); depending on where your school and its learners are located, it may also include laws such as the EU or UK General Data Protection Regulation or applicable US state privacy laws. You will use the Service in compliance with those laws.
As between us, your school is the "responsible party" (or "data controller") for the personal information it enters into the Service, and JourneyBase is its "operator" (or "data processor"). JourneyBase will process such personal information solely for the purpose of providing the Service, on your instructions, and will take reasonable technical and organisational measures to protect it. If your school needs a data processing agreement or another transfer mechanism required by the law that applies to it, contact us and we will work with you to put one in place.
You agree to indemnify and hold JourneyBase harmless from any claim, loss, or liability (including reasonable legal costs) arising from: (a) Your Content, including any claim that it infringes a third party's rights or was uploaded without a lawful basis; (b) your breach of these Terms; or (c) your unlawful or unauthorised use of the Service.
To the maximum extent permitted by law, JourneyBase shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Service, including loss of data, revenue, or business opportunity. JourneyBase's total liability arising out of your use of the Service shall not exceed the amount (if any) you paid to access it in the preceding 12 months.
12.1. JourneyBase may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, a payment is overdue and unresolved after reasonable notice, or we reasonably believe your use of the Service poses a risk to JourneyBase, other users, or the Service itself.
12.2. JourneyBase may also suspend, modify, or discontinue the Service generally, or your access to it, at any time, for any reason, with reasonable notice where practical.
12.3. You may stop using the Service at any time. On termination, JourneyBase may delete Your Content, subject to any separate export/retention commitment made to you in writing.
Assignment. You may not assign or transfer these Terms without JourneyBase's prior written consent. JourneyBase may assign these Terms in connection with a merger, acquisition, or sale of assets.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
Entire Agreement. These Terms (together with any order form or plan you've agreed to) are the entire agreement between you and JourneyBase regarding the Service, and supersede any prior agreement or understanding on the subject.
Force Majeure. JourneyBase is not liable for any failure or delay caused by events outside its reasonable control, including outages of third-party infrastructure providers.
Third-Party Services. The Service integrates with third-party providers (e.g. PayFast for payments, Google for sign-in). JourneyBase is not responsible for the availability or performance of those third-party services.
JourneyBase may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.
JourneyBase is operated from South Africa and may be used by driving schools in any country. Each school is responsible for making sure that its use of the Service, and the instruction and records it keeps with it, comply with the laws and regulations of the places where it operates — including driver-training and instructor licensing rules, data protection and privacy law, rules on recording video or audio and on consent (including for minors), employment, consumer protection, and tax.
JourneyBase does not give legal or regulatory advice and does not represent that the Service satisfies the requirements of any particular country. Curriculum templates (such as the South African K53 template) are starting points only; your school remains responsible for what it teaches and assesses. Prices are currently shown and billed in South African Rand (see section 4). Information you enter into the Service may be stored and processed outside your country, as described in our Privacy Policy.
These Terms are governed by the laws of the Republic of South Africa, and you submit to the non-exclusive jurisdiction of the South African courts, regardless of where you or your school are located. Nothing in these Terms limits any right you have under mandatory law where you are located that cannot be excluded by agreement.
